1. General rules.
   1. The Websites are provided by established in 1998 REAL DATA S.C. company (hereinafter “RD”), with its registered office in Poland, Stargard Szczeciński (73-110), Prusa street 10/1, TAX ID 599-24-65-123.
   2. For the purposes of this document, “Websites” means:
      1. The RD website in the real-data.pl domain and subdomains, containing a description of the company and a description of the professional services provided by the company.
      2. Website and services provided by RD on its own behalf under the domain and subdomains of scubadivesoftware.com, containing content related to the broadly understood topic of diving.
      3. Selected Internet and electronic services provided on their own behalf by RD in the domain and subdomains of real-data.pl.
   3. Unless indicated otherwise, use of the Website is subject to these terms. At the same time we note that the use of some services may be subject to specific regulations, ie terms and conditions, price lists.

   5. For your convenience, this policy may also be available in other languages. The official version is Polish.
   6. RD and the user agree that any dispute will endeavor to resolve in good faith.
   7. The law applicable to all legal relations arising from these Terms are governed by Polish law.
   8. In the case where any provision of these Terms is held invalid, the remaining terms and provisions shall remain in effect.
   9. In case of disagreement, any dispute will be examined by the Polish courts of law.
   10. The user acknowledges these Terms and agree to use the Websites in subject to these Terms.
2. Copyright protection.
   1. All rights to the Websites, except for content provided by third parties, belong to the RD or entities cooperating with RD and are protected by law.

         Diving Assistant software is made available under the terms of License Agreement of Diving Assisistant Software.
   5. To build and sharing the Websites, RD uses third-party software, which are subject to the individual Terms of Use and licenses, both open source and commercial.
3. Technical requirements.
   1. RD makes significant efforts to the Websites will be available to the widest possible range of browsers and systems. Does not however guarantee that it will be available and will work correctly in all systems and devices.
   2. The recommended minimum version of the browsers are:
      1. Microsoft Edge 41.

   4. RD is not responsible in any case for consequential damages resulting from the use of the Website, even if it is advised of the possibility thereof.
   5. RD does not grant any expressed directly or indirectly related to the Websites warranty or services made ​​available on the Websites.
6. Communication.

7. Diving and safety.
   
   Although diving is becoming a safer sport, still carries the risk of injury and even death. Scuba divers should strictly follow the safety rules of this sport. The purpose of provide Website was involved in the improvement of diving safety and the promotion of the sport. In any case, the intention was not to take over RD role of dive training organizations and insurance companies, dealing with issues of diving.
   1. Scuba diving is possible only after undergoing proper training completed by an appropriate certificate.
   2. Knowledge acquired during the training, the general principles of diving, standards and recommendations of diving organizations are always take precedence over other content and information. If content of material published through the Website are opposed to it, should be considered as invalid. Please report this fact to the RD.
   3. Content and information provided through the Website can not be considered in any respect as an official training materials, guidelines or standards for diving.
   4. RD in any respect will not be responsible for any diving accidents. You agree that the sport of diving will be performed at your own risk and responsibility.
8. Final clauses.
   1. These terms and conditions shall take effect on the date of their publication on the web page referred to in General rules.
   2. RD reserves the right to change these Terms at any time without prior notice to you. Unless otherwise provided, the amendments shall enter into force upon their publication.
   3. User is obliged to follow the changes in the Terms and the contents of the license on which Website is made ​​available.
   4. RD reserves the right to terminate the Website at any time without prior notice to you.

Privacy & cookies.

1. Personal data and privacy.
   1. Administrator of your personal data.
      The administrator of personal data referred to below is established in 1998 REAL DATA S.C. company (the “RD”), with its registered office in Poland, Stargard Szczeciński (73-110), Prusa street 10/1, TAX ID 599-24-65-123. RD declares that it applies technical resources necessary to protect the data obtained.
      Correspondence to the RD should be directed via the Contact form or sent directly to the company's address.
   2. The purpose and basis of the processing of your data.
      RD does not collect personal information unless it is necessary to perform one of the following:
      1. order processing, including delivery of products,
      2. invoicing,
      3. warranty service,
      4. support filing or user complaints.
      The legal basis for the processing of personal data is your consent.
   3. The type of data being processed.
      For the purposes described above, we can collect the following data:
      1. First name and last name,
      2. Delivery address,
      3. E-mail adress,
      4. Transaction data (in the case of electronic payment).
      Providing the above data is voluntary, but necessary for the purchase of our products. RD uses the information provided above with the consent of the customer in order to send information about the status of the contract, payments and other matters related to the ordering and execution of the order. You can cancel your consent or object to the processing of your personal data at any time. However, this will not affect the legality of the actions based on your consent prior to its cancel.
   4. The period of storage of personal data.
      The data is stored for as long as it is necessary to carry out the described activities. For example, after the warranty expires, in the case of purchase of goods and payments electronically, we delete all data except the transaction number in order to allow you to recover the license key.
   5. Data source.
      We may collect personal data in the following sources:
      1. Own contact and sales forms available through the Websites (defined in Terms of Use, section I paragraph 2).
      2. In order to make payments, we use the PayPal services provided by PayPal (Europe) S.à.l. et Cie, S.C.A. (“PayPal”). We use the data obtained during payment in our systems to process orders and handle complaints. All transactions made via PayPal are processed in accordance with the PayPal Privacy Statement.
   6. Data transfer.

   7. User´s rights regarding own personal data.

      RD reserves the right to collect certain data about the use of the Website (statistics). This data is used to improve the quality of services, better serve users and to diagnose potential problems and errors in the Websites and shared software. For this purpose, some information related to the Websites is saved using “cookies” and similar technologies.

3. Final claim.
   1. Cooperators.
      This Privacy Policy does not cover the services, goods and websites of other entities with whom we cooperate. Third parties themselves, on their own and on their own responsibility, determine separate, individual rules of functioning of their services, goods and websites in their regulations.

Terms of Sale (Sales Policy)

This terms applies to online sales (the Store), owned by REAL DATA S.C. with its registered office in Stargard Szczeciński (postal code 73-110), Prusa street 10/1, number: 210975561, : Tax Id: 599-24-65-123 (hereinafter RD).

1. General rules.
   1. Sales in the Store is implemented only on the following web sites and subpages (Sites):
      1. SCUBADIVESOFTWARE (www.scubadivesoftware.com),
      2. REAL DATA (www.real-data.pl).
      Orders can be placed only through listed Sites.
   2. Buyer is obligated to read Terms of Use appropriate for these sites and follow them.
   3. Content of websites www.scubadivesoftware.com and www.real-data.pl are not an offer within the meaning of Civil or Commercial Code.
   4. Placing an order by Buyer means a purchase offer and is not tantamount to concluding a sales contract.
   5. The date of confirmation of the order by RD is considered the date of sale. Confirmations will be sent in electronic form to the e-mail address provided by the Buyer.
   6. All prices quoted in Store are gross prices and include VAT.
   7. The price of the products pressented on the Store website at the time of the Order is the price applicable to the parties of the transaction.
   8. The territory of the Republic of Poland is considered as the place of sale. The business activity of the sale is carried out under Polish law.
2. Settlements.
   1. Payments for products purchased in Store can be in one of the following forms:
      1. Through the PayPal payment provider (www.paypal.com),
      2. By bank transfer, the account number is given along with the conformation of the Order.
   2. Accounting currency is Złoty Polski (PLN). Tax rates are applied respectively for Poland.
   3. Payment in any other currency is possible only through the payment provider. The conversion into PLN is made by the provider, in accordance with its conversion table. The payment operator may charge additional fees for payments.
   4. Invoices will be issued on demand in accordance with Polish regulations. Proof of purchase will be sent to the address provided during payment. Electronic form is permitted. RD may contact client via e-mail or provided phone number to confirm the correct address.
   5. Orders not paid within 7 business days are considered void and have not been completed.
3. Completion of an Order.
   1. Store performs only Electronic Delivery.
   2. RD starts completion of Order after confirmation of payments for purchased products:
      1. In case of payment operator, after receipt from the operator acknowledgment of transation,
      2. In the case of a transfer to a bank account after receiving the full amount on the bill.
   3. Delivery of products is carried out within a term of 7 working days from confirmation of payment referred to in the paragraph above. However, we try to make this time not longer than one calendar day.
   4. Electronic delivery of License Keys or link to download the product, sent to e-mail provided by Buyer durring payment is considered to be completion of the Order.
4. Final clauses.
   1. These Sales Policy shall enter into force on the date of their publication on the website referred to in General rules.
   2. RD reserves the right to change these Terms at any time without prior notice to the user. Unless otherwise indicated, changes to the regulations come into force upon their publication.
   3. The User is obliged to track changes in the Terms of Use, Terms of Sale and content licenses on which the sites is made ​​available.
   4. RD reserves the right to close the Store at any time, without prior notice to the user.
